In periods of economic crisis, the protection of social rights tends to be more difficult and can be reduced. In regional States the question is more problematic, due to the fragmentation of competences between State and Regions and to the exigences of differentiation expressed by the territorial communities. States have structured different mechanisms in order to assure a minimum standard of social rights on the national territory and to grant the budgetary balance.
In this paper the choices made in the Italian and Spanish juridical order and their critical issues are examined and compared, and some possible solutions are provided.
