Il commento analizza la recente sentenza Dobbs della Corte Suprema degli Stati Uniti, collocando l’overruling di Roe v. Wade nel contesto di un lungo percorso giurisprudenziale e legislativo. Il contributo si sofferma, inoltre, sull’utilizzo del dato storico da parte della maggioranza, rilevandone le intrinseche distorsioni e contraddittorietà e riflette sul futuro del diritto all’aborto e di altri diritti negli Stati Uniti.

The contribution analyses the recent ruling of the Supreme Court of the United Staes in Dobbs, placing the controversial overruling of Roe v. Wade in the context of a long judicial and legislative background. The contribution also focuses on the use of tradition by the majority, emphasising some of its inherent distortions and contradictions and analyses the future of the right to abortion and other rights in the United States.
