Abstract (in italiano)
Il contributo analizza la sentenza n. 10 del 2024 della Corte costituzionale, che ha dichiarato l’illegittimità costituzionale dell’art. 18 ord. penit. nella parte in cui non prevede la possibilità che i detenuti possano svolgere colloqui riservati con i propri partner senza il controllo a vista del personale di custodia.
L’analisi adotta una duplice prospettiva: esamina il percorso giurisprudenziale che ha condotto alla pronuncia e le argomentazioni della Consulta; e verifica l’effettiva attuazione del diritto all’affettività a oltre due anni dalla pronuncia, evidenziando le criticità emerse e il tormentato percorso che ha portato all’emanazione delle linee guida del Dipartimento dell’Amministrazione Penitenziaria nell’aprile del 2025.
Particolare attenzione è dedicata alle prestazioni necessarie per rendere effettivo il diritto riconosciuto dalla Corte costituzionale e al ruolo che le Regioni possono svolgere, nell’ambito dei servizi sociali e assistenziali, ai fini della sua concreta attuazione.

The article analyses Constitutional Court judgment no. 10/2024, which declared the unconstitutionality of Article 18 of the Italian Penitentiary Act because it does not allow inmates to have private visits with their partners without being under the direct supervision of prison staff.
The analysis adopts a dual perspective: it examines the jurisprudential path leading to the judgment and the reasoning of the Constitutional Court; and verifies the effective implementation of the right to intimacy over two years after the decision, highlighting the critical issues and the difficult path that led to the publication of the guidelines by the Department of Prison Administration in April 2025.
Particular attention is paid to the services necessary to make effective the right recognised by the Constitutional Court and to the role that Regions can play in this regard within the framework of social and welfare services.
